These Car Rental Terms & Conditions ("Rental Terms") govern all self-drive and chauffeur-driven vehicle rental services provided by Universal Eden Holidays Sdn. Bhd. ("the Company"). These Rental Terms are in addition to, and form part of, the Company's general Terms & Conditions.
By confirming a car rental booking, the renter ("Renter", "Driver") agrees to be bound by these Rental Terms.
Eligibility Requirements
1.1 The Renter must hold a valid and current driving licence that is recognized in Malaysia.
1.2 For self-drive rentals, the minimum age requirement is twenty-one (21) years unless otherwise stated.
1.3 Foreign nationals must present an International Driving Permit (IDP) together with their home country licence, unless their licence is issued in English and recognized under Malaysian law.
1.4 The Company reserves the right to refuse a rental where eligibility requirements are not satisfied.
1.5 Only the Renter named in the booking confirmation is authorized to drive the vehicle unless additional drivers have been declared and approved in writing.
Booking and Confirmation
2.1 All vehicle rentals are subject to availability and confirmation by the Company.
2.2 A rental booking is confirmed only upon receipt of payment and issuance of a booking confirmation by the Company.
2.3 The Company reserves the right to substitute a confirmed vehicle with a vehicle of equivalent or superior category where the originally booked vehicle is unavailable.
2.4 The Renter must inspect the vehicle at the time of collection and report any pre-existing damage before departing. Failure to report pre-existing damage may result in the Renter being held liable.
Security Deposit
3.1 A refundable security deposit may be required at the time of vehicle collection, depending on the vehicle category and rental duration.
3.2 The deposit amount will be communicated in the booking confirmation.
3.3 The deposit will be refunded in full after the vehicle is returned in satisfactory condition, subject to inspection.
3.4 The Company reserves the right to deduct from the security deposit any amounts owed for damages, outstanding charges, fines, fuel shortfalls, or cleaning fees.
Rental Period
4.1 The rental period commences at the time of vehicle collection and ends at the agreed return date and time stated in the booking confirmation.
4.2 Extensions to the rental period must be requested and approved in writing before the scheduled return time.
4.3 Unauthorized extensions will be charged at the Company's prevailing daily rate, plus an administrative fee.
4.4 Late returns without prior approval may result in additional charges.
Vehicle Collection and Return
5.1 The Renter must collect the vehicle at the agreed time and location specified in the booking confirmation.
5.2 The Company shall wait a maximum of thirty (30) minutes at the agreed collection time. Failure to collect within this period without prior notice may be treated as a no-show, and no refund will be issued.
5.3 The vehicle must be returned to the agreed return location at the agreed time in the same condition as collected.
5.4 Any damage, soiling, or missing accessories discovered upon return will be assessed and charged accordingly.
Fuel Policy
6.1 Vehicles are provided with a full tank of fuel and must be returned with a full tank unless a different fuel policy is specified in the booking confirmation.
6.2 Failure to return the vehicle with the agreed fuel level will result in a refuelling charge, plus an administrative fee.
6.3 The Renter is responsible for ensuring the correct fuel type is used. Damage caused by misfuelling shall be borne by the Renter.
Renter Responsibilities
7.1 The Renter is solely responsible for the vehicle from the time of collection to the time of return.
7.2 The Renter must comply with all Malaysian traffic laws, road regulations, and parking requirements at all times.
7.3 The Renter is responsible for all costs arising from:
- Traffic fines and summons;
- Parking violations;
- Toll charges;
- Loss of vehicle keys or access cards;
- Loss or damage to vehicle accessories, documents, or registration cards;
- Towing charges resulting from the Renter's actions;
- Cleaning charges where the vehicle is returned in an unacceptably soiled condition.
7.4 The Renter must notify the Company immediately in the event of an accident, theft, breakdown, or any incident involving the vehicle.
7.5 The Renter must not attempt unauthorized repairs to the vehicle.
Prohibited Uses
8.1 The vehicle must not be used for any of the following purposes:
- Illegal activities or transportation of prohibited goods;
- Racing, rallying, or any competitive driving events;
- Off-road driving (unless the vehicle is specifically designated for such use);
- Transporting more passengers than the vehicle's licensed seating capacity;
- Towing or pushing other vehicles without prior written approval;
- Driving under the influence of alcohol, drugs, or any substance that impairs driving ability;
- Sub-letting, re-renting, or transferring the vehicle to any third party;
- Driving outside of Peninsular Malaysia, Sabah, or Sarawak without prior written consent.
8.2 Any breach of the prohibited uses clause will render the Renter fully liable for all damages, costs, and losses, and may result in immediate termination of the rental without refund.
Accidents and Incidents
9.1 In the event of an accident, the Renter must:
- Ensure personal safety and the safety of all parties involved;
- Notify the police and obtain a police report where required;
- Contact the Company immediately to report the incident;
- Not admit liability to any third party without the Company's written consent;
- Provide full details of any third parties involved, including names, contact numbers, and vehicle registration numbers;
- Cooperate fully with the Company, insurer, and authorities.
9.2 Failure to follow the accident reporting procedure may result in the Renter bearing full liability for all resulting costs.
Damage Policy
10.1 The Renter is responsible for all damage to the vehicle occurring during the rental period, regardless of fault, including but not limited to:
- Collision damage to the vehicle body, glass, tyres, and undercarriage;
- Interior damage;
- Damage resulting from negligence or reckless driving;
- Damage caused by misuse or prohibited use of the vehicle.
10.2 Damage assessments will be conducted upon vehicle return and costs will be determined based on repair estimates or replacement costs.
10.3 Where a vehicle is rendered undriveable due to damage, the Renter may also be liable for loss of revenue during the repair period.
Vehicle Breakdown
11.1 In the event of a mechanical breakdown not caused by the Renter's actions, the Company will make reasonable efforts to provide roadside assistance or a replacement vehicle.
11.2 No refund will be provided for breakdowns caused by the Renter's negligence, misuse, or prohibited use.
11.3 The Renter must not attempt unauthorized repairs or engage third-party mechanics without prior approval from the Company.
Insurance
12.1 All Company rental vehicles carry third-party motor insurance as required by Malaysian law.
12.2 The Renter may be liable for an excess amount in the event of a claim, as specified in the booking confirmation.
12.3 Insurance coverage does not apply where:
- The vehicle is used in violation of these Rental Terms;
- The driver is found to be driving under the influence of alcohol or drugs;
- The damage is caused by an unauthorized driver;
- The Renter fails to report an accident as required.
12.4 The Company strongly recommends that Renters obtain personal travel insurance to cover personal accident and third-party liability.
Cancellation and Refunds
13.1 Cancellation of confirmed car rental bookings is subject to the following charges:

13.2 All cancellation requests must be submitted in writing to the Company.
13.3 Payment gateway and transaction fees are non-refundable.
Limitation of Liability
14.1 The Company shall not be liable for any loss, injury, or damage arising from the use of the rental vehicle, including but not limited to accidents, theft, or mechanical failure caused by the Renter's actions.
14.2 The Company shall not be liable for any personal belongings left in the vehicle.
14.3 To the fullest extent permitted by law, the Company's liability shall be limited to the rental charges paid by the Renter.
Governing Law
15.1 These Car Rental Terms & Conditions are governed by the laws of Malaysia.
15.2 Any disputes arising from a car rental arrangement shall be subject to the exclusive jurisdiction of the courts of Malaysia.
